Service Limitations and Scope

Swimpool 360 provides pool installation, renovation, landscaping, and maintenance services in the Greater Toronto Area (GTA) and surrounding regions of Ontario. Our service scope is defined in individual written agreements with each client. No service commitment is created by the general descriptions of services on this website.

The following service limitations apply to all work performed by Swimpool 360:

All work is performed subject to applicable Ontario building codes, municipal permits, and zoning regulations. Swimpool 360 cannot guarantee permit approval or specific permit timelines as these are determined by municipal authorities.
Project timelines are estimates. Delays caused by weather, permit processing, utility conflicts, material supply, or other factors outside Swimpool 360's control do not constitute breach of contract.
Swimpool 360 is not responsible for pre-existing conditions at a client's property including underground obstructions, contaminated soil, unstable ground conditions, or undisclosed utility infrastructure.
Pool performance and longevity depend significantly on proper homeowner maintenance including regular chemical treatment, seasonal opening and closing, and equipment servicing. Failure to maintain a pool properly may void applicable warranties.
Pool renovation and repair assessments are based on visible conditions at the time of inspection. Hidden defects discovered during work may affect project scope and cost and will be communicated to the client before proceeding.

Warranty Disclaimer

Swimpool 360 warrants its workmanship for the period specified in each client's written service agreement. Workmanship warranties cover defects arising from installation or construction errors by Swimpool 360 crews and do not cover: normal wear and tear, damage from improper homeowner maintenance, acts of nature, vandalism, misuse, or modification of completed work by the homeowner or third parties.

Equipment, materials, and products installed by Swimpool 360 (including pumps, filters, heaters, liners, shells, and automation systems) are covered by their respective manufacturer warranties, not by Swimpool 360 workmanship warranties. Swimpool 360 will assist clients in making warranty claims with manufacturers where applicable, but cannot extend or guarantee manufacturer warranty coverage.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SWIMPOOL 360 DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. This disclaimer does not affect statutory rights you may have under Ontario's Consumer Protection Act, 2002 or other applicable legislation, which cannot be waived by contract.

Limitation of Liability

This liability disclaimer for pool contractors in Ontario is enforceable to the fullest extent permitted by applicable law. Swimpool 360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of profits, loss of data, loss of goodwill, property damage beyond the scope of services rendered, personal injury not attributable to Swimpool 360 negligence, or costs of substitute services.

Our maximum aggregate liability for direct damages arising from services rendered is limited to the amount paid by the client for the specific service that gave rise to the claim. This limitation does not apply to claims arising from gross negligence, intentional misconduct, or fraud by Swimpool 360.

Swimpool 360 is not responsible for outcomes resulting from:

Pre-existing conditions at a client's property that were not disclosed or reasonably discoverable during site assessment
Force majeure events including severe weather, flooding, fire, or acts of government
Client modifications to completed work without Swimpool 360's written authorization
Work performed by third-party contractors not engaged by Swimpool 360
Failure to obtain required municipal permits or approvals by the client

Nothing in this disclaimer limits or excludes liability that cannot be limited or excluded under applicable Ontario or Canadian law, including liability for death or personal injury caused by negligence.
